Bar: Former IGP’s call same creature, different name E-mail

THE Bar Council yesterday said it was heartened by the acknowledgment of a former top cop that the police needed an independent oversight body.

Its president, Lim Chee Wee said the call made by former Inspector-General of Police Tan Sri Musa Hassan was timely and would be strongly welcomed by most.

Musa had called on the government to set up an independent body to oversee police conduct in the wake of several custodial deaths. Musa said he preferred an alternative to the Independent Police Complaints and Misconduct Commission (IPCMC), as he disagreed with one of the clauses that barred police officers from appealing action taken against them.

He said an alternative to the IPCMC is the Police Integrity Commission. Lim said while Musa might be right about a particular shortcoming of the proposed IPMC, that does not mean it cannot be established.

“The model which Musa proposes is merely the same creature with a different name.”

30 days' jail for insulting queen E-mail

REMORSEFUL: Man also fined RM8,000

BALIK PULAU: THE man who flashed his middle finger at  Raja Permaisuri Agong Tuanku Hajah Haminah has landed himself in jail for 30 days.

Leong Pei Koe, 29, was also fined RM8,000 yesterday after he pleaded guilty to making the obscene hand gesture.

The quantity surveyor from Subang Jaya, Selangor, was a picture of remorse before he was sentenced by magistrate Muhamad Hidayat Wahab yesterday afternoon.

Speaking in English, Leong who had no lawyer, said he was sincerely sorry for what he had done.

He apologised to the Raja Permaisuri Agong, police and also the people of Malaysia.

"I promise that I will not do it again," he said in a choked voice.

Leong faced two charges of committing obscene acts in public.

Request for Feedback on Rules of Court 2012

Reference is made to Circular No 142/2012 dated 2 July 2012, Circular No 146/2012 dated 3 July 2012, Circular No 152/2012 dated 12 July 2012, Circular No 165/2012 dated 31 July 2012, Circular No 167/2012 dated 2 Aug 2012, Circular No 174/2012 dated 9 Aug 2012 and Circular No 205/2012 dated 19 Sept 2012.

In the abovementioned circulars, Members were notified, inter alia, of the following:

(a) The Rules of Court 2012 [PU (A) 205/2012] came into force on 1 Aug 2012.  On the same day, the Subordinate Courts Rules 1980 and the Rules of the High Court 1980 were repealed;

(b) The Rules of Court 2012 are to be read together with the Corrigendum [PU (A) 226/2012] which was gazetted on 25 July 2012, and the Rules of Court (Amendment) 2012 [PU (A) 232/2012] which was gazetted on 1 Aug 2012; and

(c) Order 91 of the Rules of Court 2012 and Appendix B1 and Appendix B2 (ie the revised schedule of filing fees for the subordinate courts and the High Court) will only come into effect when the Subordinate Courts (Amendment) Act 2010 comes into effect. In the meantime, the schedule of filing fees that is applicable for the subordinate courts and the High Courts is as per Schedule B of the Subordinate Courts Rules 1980 and Appendix B of the Rules of the High Court 1980, respectively.

> Uncontrolled agriculture activities threaten livelihood, say orang asli families

GUA MUSANG: About 50 orang asli families in the Seng Sang village claim uncontrolled agriculture activities have polluted the river they depend on and stripped the jungle of resources vital to their lives.

Alang Terawas (pix), 63, said his Temiar tribe, who reside in the village, once lived by utilising the resources provided by nature
around them.

But not anymore. Sungai Belatop next to the village has become muddy while the jungle, where they used to hunt and collect forest products, has become barren with all the valuable timber logged and used for cultivating vegetables in farms that do not belong to them.

“This village is the nearest to Lojing and the river flowing from the mountain is the main source of water for residents here.

“But the river is becoming more and more polluted because of the uncontrolled agriculture activities.
 
President’s Message (Praxis, Jan-Mar 2013): Corruption in the Legal System and Challenges of Leadership E-mail

On behalf of the Bar Council, I wish all Members of the Bar a Happy and Blessed New Year. 

For the Malaysian Bar, 2012 was a year charged with changes and controversies, compliments and condemnations.  It is already apparent that 2013 will see more of the same, and indeed much more so, not least because of the nation’s imminent 13th General Election. 

In this message, I wish to touch on two issues that will remain in the spotlight after I pass the baton (but not the buck) to the incoming President, one day after the Ides of March.       

Corruption in the legal system

It is a truism that the vast majority of judges and lawyers are honest, and that it is only a few rotten apples that ruin the reputation of the rest.  I have highlighted in the media the existence of corruption in the Judiciary, and also the resolve and readiness of the Chief Justice, Attorney General, Bar Council, and Malaysian Anti-Corruption Commission (“MACC”) Chief Commissioner to rid our justice system of this rot. 
 
Citizens’ eyes on Lynas E-mail

PETALING JAYA (Feb 11, 2013): Concern over the Lynas rare earth project in Kuantan has led a group of professional Malaysians to form a citizens watch group to monitor the project closely.

"Our group consists of highly qualified professionals with skills, knowledge and experience in engineering, medical and health, legal as well as other fields of work," said the group's spokesman, Alia Mohamad Said.

Alia, who is a lawyer, said the group is committed to strict professional ethics to watch over the project and hold the government accountable for their regulatory roles.
